New Employer Obligations Under the Directive on Transparent and Predictable Working Conditions — What Should Employers Be Aware Of?

Työehtodirektiivin myötä uusia työnantajavelvollisuuksia – mitä työnantajan tulee huomioida?

Juuri kun vilkkain lomakausi lähestyy loppuaan ja työelämään pikkuhiljaa palataan täynnä intoa, Suomessa ollaan implementoimassa avoimia ja ennakoitavia työehtoja koskeva EU-direktiivi[1]. Direktiivin ja työlainsäädäntömuutosten tarkoituksena on parantaa muun muassa vaihtelevalla työajalla ja osa-aikaisissa työsuhteissa työskentelevien työntekijöiden asemaa edistämällä nykyistä turvatumpia ja ennakoitavampia työehtoja. Lisäksi työnantajan tulee jatkossa antaa laajemmat tiedot työntekijän työehdoista. Lainsäädäntömuutokset tulevat voimaan 1.8.2022.

Seuraavaksi tiivistämme lainsäädäntömuutosten keskeisimmät vaikutukset ja asiat, joita työnantajan tulee huomioida sekä nykyisten että tulevien työntekijöiden osalta.

Entistä laajempi kirjallinen selvitys työnteon keskeisistä ehdoista

Työnantajalla on jo voimassa olevan lainsäädännön nojalla tietyissä tapauksissa ollut velvollisuus antaa työntekijälle työsuhteen alussa kirjallinen selvitys työnteon keskeisistä ehdoista, kuten noudatettavasta työajasta, työntekopaikasta ja pääasiallisista työtehtävistä, jos tiedot eivät ilmene kirjallisesta työsopimuksesta. Jatkossa työnantajan tiedonantovelvollisuus kuitenkin laajenee hiukan, sillä lainsäädäntömuutoksen myötä työnantajan tulee sisällyttää annettaviin tietoihin myös esimerkiksi

(i) tietoa mahdollisesta lakiin, sopimukseen tai käytäntöön perustuvasta oikeudesta työnantajan tarjoamaan koulutukseen

(ii) tietoa vakuutuslaitoksista, joissa työnantaja on järjestänyt työntekijälle eläketurvan ja vakuuttanut tämän työtapaturman ja ammattitaudin varalta

(iii) vuokratyöntekijälle tietyt laissa määritellyt tiedot

(iv) vaihtelevaa työaikaa noudattavalle työntekijälle tietyt laissa määritellyt tiedot

(v) vähintään kuukauden kestävässä ulkomaantyössä työskentelevälle työntekijälle tietyt laissa määritellyt tiedot.

Selvityksen antamiselle asetetaan täsmälliset määräajat: osa tiedoista on annettava seitsemän päivän kuluessa ja osa kuukauden kuluessa työnteon aloittamisesta. Vähintään kuukauden kestävässä ulkomaantyössä työskentelevälle työntekijälle annettavat tiedot on annettava ennen työntekijän lähtöä ulkomaille.

Pääsääntö on, ettei työnantajan tarvitse täydentää kirjallista selvitystä sellaisten tietojen osalta, joita ei ennen tämän lain voimaantuloa ole edellytetty, jos työsopimus on tehty ennen lainsäädäntömuutosten voimaantuloa. Jos työehtoihin tulee muutoksia, työntekijälle on kuitenkin annettava kirjallinen selvitys niin pian kuin mahdollista, viimeistään kuitenkin muutoksen tullessa voimaan (paitsi jos muutos johtuu lainsäädännön tai työehtosopimuksen muuttamisesta). Vaihtelevalla työajalla työskenteleviin työntekijöihin liittyy myös poikkeus, sillä työsopimuslain nojalla heille annettavat tiedot on annettava kolmen kuukauden kuluessa lainsäädäntömuutosten voimaantulosta.

Vaihtelevaa työaikaa tarkasteltava säännöllisesti

Vaihtelevalla työajalla tarkoitetaan työskentelymuotoa, jossa ei ole kiinteää tuntimäärää, vaan työaika vaihtelee määrättynä ajanjaksona sovitun vähimmäis- ja enimmäismäärän välillä (kuten 5–30 tuntia viikossa). Myös tarvittaessa työhön kutsuttavat työntekijät ovat vaihtelevan työajan piirissä. Voimassa olevan lainsäädännön mukaan vaihtelevasta työajasta ei ole saanut työnantajan aloitteesta sopia, jos työnantajan työvoimatarve on ollut kiinteä, eikä vaihtelevaa työaikaa koskevaan ehtoon sisältyvää vähimmäistyöaikaa ole työnantajan aloitteesta saanut sopia pienemmäksi kuin työnantajan työvoiman tarve on edellyttänyt.

Edellä mainitut velvollisuudet säilyvät, mutta lainsäädäntömuutosten myötä työnantajalle tulee entistä laajempi velvollisuus tarkastella työsopimuksella sovittua tuntimäärää vähintään 12 kuukauden välein. Mikäli työntekijän toteutuneet työtunnit ja työvoiman tarve osoittavat, että työntekijän vähimmäistyöaika pitäisi määritellä korkeammaksi, työntekijälle tulisi tarjota vähimmäistyöajan nostamista kuukauden kuluessa tarkastelun suorittamisesta. Työnantajan tulee huomioida, että lainsäädäntömuutosten voimaan tullessa voimassa olevien työsuhteiden osalta tarkastelu on tehtävä vuoden kuluessa lain voimaantulosta.

Työnantajan on ilmoitettava työntekijälle edellä mainitun tarkastelun ajankohta ja pyynnöstä esitettävä kirjallinen selvitys tarkastelun tuloksesta ja sen perusteena olevista seikoista. Työnantajan tulee lisäksi huomioida, että jos työnantaja lopettaa työn tarjoamisen kokonaan, työnantaja on pyynnöstä selvitettävä kirjallisesti tarjolla olevan työn vähentymisen syyt.

Vaihtelevan työajan järjestelyihin tulevat muutokset näkyvät myös muutoksina työaikalakiin. Työaikalaissa säädetään jatkossa työvuoron teettämisen tilanteista, jotka vaativat työntekijän suostumuksen kutakin kertaa varten erikseen tai lyhyehköksi ajaksi kerrallaan. Suostumus on pyydettävä työntekijältä silloin, (i) kun työvuoro sijoittuu työsopimuslaissa tarkoitettujen viikonpäivien tai kellonaikojen ulkopuolelle tai (ii) kun työaika ylittää vaihtelevan työajan sopimuksessa sovitun vähimmäistyöajan määrän.

New Employer Obligations Under the Directive on Transparent and Predictable Working Conditions — What Should Employers Be Aware Of?

As the holiday season is coming to an end and people begin to return to work, Finland is implementing the EU Directive on Transparent and Predictable Working Conditions[2]. The purpose of the Directive and the legislative amendments is, among other things, to improve the position of employees with variable working hours and employees with part-time agreements by promoting more secure and predictable working conditions. Employers will also be required to provide more extensive information about employees’ terms of work. The legislative amendments will enter into force on 1 August 2022.

Here follows a summary of the most central legislative amendments and matters of which employers should be aware with respect to both current and future employees.

More Extensive Written Information on the Principal Terms of Work

Pursuant to current legislation and under certain circumstances, employers are already obligated to provide employees with written information on the principal terms 0f work, such as applicable working time, place of work, and principal work tasks, unless such information is provided in the written employment agreement. In the future, the employer's information obligation will be slightly extended, as employers will, pursuant to the legislative amendments, also be required to provide information on, for example

(i) potential statutory, contract-based, or practice-based right to training provided by the employer

(ii) from which insurance companies the statutory pension insurance and worker’s compensation insurance are subscribed

(iii) certain mandatory information with respect to rented work force

(iv) certain mandatory information with respect to employees who have variable working hours

(v) certain mandatory information with respect to employees who work abroad for at least one month.

The legislative amendments contain set time limits for the provision of written information: part of the statutory information must be provided within seven days and part of it within one month of the commencement of the work. The statutory information to be provided to an employee who will be working abroad for at least one month will have to be provided before the employee goes abroad.

As a main rule, employers will not have to supplement the written information with respect to information that has not been required before the legislative amendments enter into force, if the employment agreement has been concluded before the legislative amendments enter into force. However, if the terms of work change, the employee must be informed about the changes in writing as soon as possible, but in any case no later than when the changes enter into force (unless the changes derive from amendments to legislation or the collective bargaining agreement). Another exception applies to employees with variable working hours, as certain information set out in the Finnish Employment Contracts Act must be provided within three months of the legislative amendments entering into force.

Variable Working Hours to Be Reviewed Regularly

Variable working hours means that a fixed number of working hours has not been agreed upon with an employee, but the working hours vary between an agreed maximum and minimum number during a certain period of time (e.g. 5–30 hours per week), or work to be carried out when separately requested by the employer. Pursuant to current legislation, variable working hours may not be agreed upon at an employer’s initiative if the employer’s need of workforce is fixed, nor may the minimum number of working hours be agreed at the employer’s initiative to be less than the employer’s actual need of workforce.

The aforementioned obligations will remain, but as a result of the legislative amendments, employers’ obligation to review the agreed working hours will be extended, as employers will be obligated to review the working hours clause at least every 12 months in the future. If the worked hours of an employee and the need of workforce indicate that the employee’s minimum working hours should be increased, the employee’s minimum working hours must be increased within one month of the review. Employers should note that with respect to employments that are in force when the legislative amendments enter into force, a statutory review must be carried out within one year of the legislative amendments entering into force.

Employers must inform employees about the timing of the aforementioned review and upon request provide written information about the result of the review and the grounds thereof. Employers should further note that if they completely cease to offer an employee work, they are upon request required to provide written information about the reasons for the decreased need of workforce.

The amendments concerning variable working hours arrangements are also reflected in the Working Hours Act. In the future, the Act will cover situations where an employee’s consent is separately required each time or for short periods at a time for including work shifts in the work schedule. The employee’s consent is required, for instance, (i) when the work shift is placed outside weekdays or times of the day set out in the Employment Contracts Act, or (ii) when the working hours exceed the agreed minimum number of working hours.
